Van Amburgh Mutual Release and Settlement - Recorded 2025

Recorded settlement regarding Van Amburgh adverse possession claim.

This agreement resolves a property dispute between the homeowner and the Annapolis Roads Property Owners Association and ends the lawsuit.

Under the settlement:

  • The Property Owners Association retains full ownership of the disputed land.

  • The homeowner does not gain ownership of the property.

  • The homeowner made a one-time payment to resolve the dispute.

  • In return, the homeowner received a 20-year, non-exclusive license to use the area for limited residential purposes, similar to a backyard.

  • Existing features, such as a shed and garden, may remain and be maintained, but no new construction or expansion is allowed.

  • After 20 years, the license expires and use of the area must end unless a new agreement is reached.

Both sides agreed to dismiss the case permanently, release all related claims, and record the agreement in county land records so the terms are clear to future owners. The settlement brings certainty, avoids prolonged litigation, and clearly defines property ownership and permitted use going forward.
